Section 1 — Access and Account
By agreeing to these Terms you confirm you are at least the age of majority in your State or Territory of residence. To use the Services you may be asked to provide information such as your email address and billing, payment and shipping details. You represent that all information you provide is correct, current and complete, and are responsible for maintaining the security of your account.
Section 2 — Our Products
We make every effort to represent our products accurately. Colours and appearance may differ from how they appear on your screen. Descriptions and availability are subject to change at any time, and we may limit quantities offered to any person or region.
Section 3 — Orders
When you place an order you are making an offer to purchase. Arlisse reserves the right to accept or decline your order at its discretion; your order is not accepted until we confirm acceptance and process payment. Your purchases may be returned in accordance with our Return & Refund Policy and your rights under the Australian Consumer Law.
Section 4 — Prices and Billing
All prices are listed in AUD. Arlisse is a small business and is not currently registered for GST, so no GST is charged and tax invoices cannot be issued. Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation. You warrant that the payment information you provide is true and that you are authorised to use the payment method.
Section 5 — Shipping and Delivery
Please refer to our Shipping Policy for details on processing, transit and delivery. All delivery times are estimates and are not guaranteed. Once we transfer products to the carrier, title and risk of loss pass to you.
Section 6 — Intellectual Property
Our Services, including all trademarks, text, images, graphics, video and audio and their arrangement, are owned by Arlisse, its operator or licensors and are protected by applicable intellectual property laws. These Terms permit you to use the Services for personal, non-commercial use only. Arlisse names, logos and designs may not be used without prior written permission.
Section 7 — Third-Party Tools and Links
Third-party tools and links are provided “as is” and “as available” without warranties. We are not responsible for the content or accuracy of third-party materials, and any use is at your own risk.
Section 8 — Relationship with Shopify
Arlisse is powered by Shopify, which enables us to provide the Services. Any sales you make are made directly with Arlisse. You acknowledge that Shopify is not responsible for any aspect of sales between you and Arlisse.
Section 9 — Privacy
All personal information we collect is subject to our Privacy Policy. Certain personal information may also be subject to Shopify’s Privacy Policy at https://www.shopify.com/legal/privacy.
Section 10 — Feedback
If you submit ideas, suggestions, reviews or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display it for any purpose. You represent that you own or have all necessary rights to your Feedback.
Section 11 — Errors, Inaccuracies and Omissions
Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping or availability. We reserve the right to correct any errors and to change or update information or cancel orders where information is inaccurate, without prior notice.
Section 12 — Prohibited Uses
You may use the Services for lawful purposes only. You may not use them to violate any law, infringe intellectual property, harass or harm any person, transmit false information, send spam, impersonate others, or engage in any conduct that may harm Arlisse, Shopify or other users.
Section 13 — Disclaimer and Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law that cannot lawfully be excluded. Subject to those rights, and to the fullest extent permitted by law, the Services and products are provided “as is”, and Arlisse and HE4L LTD are not liable for any indirect, incidental, special or consequential loss arising from your use of the Services. Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to the resupply of the goods or the cost of resupply.
Section 14 — Indemnification
You agree to indemnify and hold harmless Arlisse, HE4L LTD, Shopify and our affiliates from any losses or claims, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law or third-party right, or your use of the Services.
Section 15 — Severability and Entire Agreement
If any provision is found unlawful or unenforceable, it is severed without affecting the remaining provisions. These Terms and any policies posted by us constitute the entire agreement between you and us.
Section 16 — Governing Law
These Terms are governed by the laws of England and Wales, without prejudice to the mandatory consumer-protection rights available to you under the Australian Consumer Law and the laws of your State or Territory of residence, which continue to apply.
